1. Acceptance of Terms

By accessing or using Adorie ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Adorie is an AI-powered platform that allows users to create websites through natural language conversations via chat applications (WhatsApp, Telegram, iMessage) and a web-based builder. The Service uses artificial intelligence to generate, host, and maintain websites based on your instructions.

3. Eligibility

You must be at least 13 years old to use the Service. By using Adorie, you represent that you meet this age requirement.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information.
• You are responsible for all activity that occurs under your account.
• You may not share account credentials or allow others to access your account.

5. Acceptable Use

You agree not to use the Service to:

• Create websites that contain illegal, harmful, or offensive content.
• Create or operate gambling, betting, casino, sports-book, lottery, raffle, sweepstakes, fantasy-sports-for-money, blackjack, poker, slot, roulette, or any other real-money or cryptocurrency wagering services, including sites that accept stakes, distribute prizes of monetary value, or facilitate any form of online gambling. This applies regardless of jurisdiction or whether such activity is licensed locally.
• Create, host, distribute, link to, advertise, or facilitate access to adult or sexually explicit material of any kind, including pornography, nudity, escort or sex-work services, fetish content, AI-generated sexual imagery, sexually suggestive depictions of real or fictional persons, or any platform whose primary purpose is the exchange of such material. Any content sexualizing or depicting minors is strictly prohibited and will be reported to appropriate authorities.
• Create, promote, sell, market, distribute, or facilitate the sale of illegal drugs, controlled substances, drug paraphernalia, prescription medications without proper authorization, synthetic cannabinoids, designer drugs, or any product or service that violates applicable narcotics or controlled-substances laws. This includes sites offering drug delivery, dispensary directories operating outside legal frameworks, or content that provides instructions for manufacturing illicit substances.
• Infringe on the intellectual property rights of others.
• Distribute malware, spam, or phishing content.
• Attempt to disrupt, overload, or reverse-engineer the Service.
• Misrepresent AI-generated content as human-created in regulated contexts (e.g., academic submissions, legal filings).
• Use AI-generated outputs in high-risk domains (medical, legal, financial advice) without independent professional review.
• Use the Service, its outputs, or any data obtained from it to develop, train, or improve competing AI models or services.
• Scrape, crawl, or automatically extract data from the Service without authorization.
• Generate content that violates applicable laws or third-party rights.

6. AI-Generated Content Ownership

You own the websites, code, and content generated through Adorie based on your prompts and instructions ("AI Output"). However:

• AI Output is subject to any third-party rights in the underlying AI models, training data, or generated content.
• Adorie makes no guarantee of uniqueness, originality, or non-infringement of AI Output.
• Similar prompts from different users may produce similar or identical outputs.
• AI Output is provided "as is" without warranty of accuracy, completeness, or fitness for any particular purpose.

7. Data Usage & AI Training

• Adorie may use anonymized and aggregated usage data to improve the Service, including AI model performance.
• Content you create through the Service may be used to develop, train, and improve Adorie's AI capabilities.
• Users on paid plans (Pro and above) may opt out of having their content used for AI training by contacting support.
• We will not sell your personal data to third parties.

8. Content You Provide

You retain ownership of the content, images, and data you provide to create your website. By using the Service, you grant Adorie a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content as necessary to provide and improve the Service.

9. Credits, Billing & Refunds

• The Service offers a credit-based system. Free users receive 5 daily credits that reset at midnight UTC and do not roll over.
• Paid plan monthly credits roll over to the next billing cycle, capped at 1x your monthly tier allowance.
• Top-up credits (purchased separately) do not expire.
• Promotional and referral credits may be subject to expiration terms specified at the time of issuance.
• All fees are non-refundable except where required by applicable law.
• Paid subscriptions renew automatically. You may cancel at any time; access continues until the end of the current billing period.
• All payments are processed securely through Stripe.

10. Subdomain Ownership

• Adorie retains ownership of all *.adorie.app subdomains.
• Subdomains are assigned for your use but may be reclaimed by Adorie with 7 days written notice.
• Subdomains may be immediately reclaimed without notice in cases of policy violations or abuse.
• Custom domains connected through the Service remain your property.

11. Stripe Connect & Platform Fees

If you use Adorie's Stripe Connect integration to sell products through your generated websites:

• Adorie charges a 5% platform fee on each transaction processed through the Service.
• Stripe's own processing fees (approximately 2.9% + 30¢) are separate and charged by Stripe directly.
• You are responsible for compliance with all applicable tax, consumer protection, and e-commerce laws.

12. Referral Program

• Referred users receive 10 bonus credits upon signup through a valid referral link.
• Referring users receive 100 bonus credits when a referred user subscribes to a qualifying paid plan.
• Referral credits are subject to standard credit terms.
• Adorie reserves the right to modify, suspend, or terminate the referral program at any time.
• Self-referrals, fake accounts, or abuse of the referral system may result in forfeiture of credits and account suspension.

13. Service Availability

We strive to keep Adorie available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service or any feature at any time without notice.

14. Limitation of Liability

• To the fullest extent permitted by law, Adorie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Adorie's total aggregate liability shall not exceed the amount you paid to Adorie in the 12 months preceding the claim.
• AI-generated outputs are provided "as is" without warranty of accuracy, reliability, or suitability. You use AI outputs at your own risk.
• Adorie is not responsible for any losses arising from reliance on AI-generated content.

15. Termination

• We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these terms or is harmful to other users or the Service.
• Upon termination for breach, all remaining credits are forfeited.
• You may delete your account at any time. Published websites will be taken offline upon account deletion.

16. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
